Citing the PAN is compulsory when filing Income Tax returns, tax deduction at source, or any other communication with the Income Tax Department. PAN is also immovably becoming a mandatory document for opening a new bank account, a new landline telephone connection / a mobile phone connection, purchase of foreign currency, bank deposits above ₹50,000, purchase and sale of immovable properties, vehicles.
In 2018 September The Supreme court has declared that the Aadhar is constitutionally valid and added that Aadhar was mandatory valid to file i-t returns and issuance of PAN card. The income tax department has been advertising linking Aadhar to PAN by 31 March 2019 for quite some time now. June 30th, 2018 was the previous deadline for linking PAN with Aadhar. It was extended for a good 9 months period for residents to make any changes to the details in the PAN and Aadhar that may be mismatched. The IT department’s recent tweet said that linking Aadhar with pan will help you to enjoy online income tax services smoothly. The tweets and advertisements do not mention the consequences for not having linked the Aadhaar and PAN.
If not linked, what will happen?
As per the Aadhaar Act and Income Tax Act, all residents in India, that is if you have resided in this country for at least 182 days then you are considered as a resident. In addition, if you are a resident, you are eligible to get an Aadhaar number and you are recommended by the law to link it to your PAN. After the Aadhar act, a new section was added under section 139A in the Income Tax Act, namely “139AA: Quoting of Aadhaar number.-
(1) Every person who is eligible to obtain Aadhaar number shall, on or after the 1st day of July 2017, quote Aadhaar number-
(i) in the application form for allotment of permanent account number;
(ii) in the return of income: Provided that where the person does not possess the Aadhaar Number, the Enrolment ID of Aadhaar application form issued to him at the time of enrolment shall be quoted in the application for a permanent account number or, as the case may be, in the return of income furnished by him.
(2) Every person who has been allotted permanent account number as on the 1st day of July, 2017, and who is eligible to obtain Aadhaar number, shall intimate his Aadhaar number to such authority in such form and manner as may be prescribed, on or before a date to be notified by the Central Government in the Official Gazette
Provided that in case of failure to intimate the Aadhaar number, the permanent account number allotted to the person shall be deemed to be invalid and the other provisions of this Act shall apply, as if the person had not applied for allotment of permanent account number.” in case a resident fails to intimate the Aadhaar number, the permanent account number allotted to the person shall be deemed to be invalid and the other provisions of this Act shall apply, as if the person had not applied for allotment of permanent account number.”
Follow these steps
➡️ Linking your PAN with Aadhar is not a big deal. Follow these steps to do it easily.
➡️ Go to the official website of IT department www.incometaxindiaefiling.gov.in
➡️ Click on the link on the left pane Link Aadhaar. You will get a new window.
➡️ Give your PAN, Aadhaar no. And enter your name exactly as given in your Aadhaar card.
Cross check before you submit the same. Your application will be verified by UIDAI. once the verification is done, your Aadhar pan linking application is confirmed.
Link Aadhaar with PAN by Sending an SMS
➡️ You have to type a message in the format
➡️UIDPAN<12 Digit Aadhaar> <10 Digit PAN>
➡️Send the message to either 567678 or 56161 from your registered mobile number
➡️ If your Aadhaar number is 09916554556 and your PAN is GHIJK5678F, you have to type UIDPAN 09916554556 GHIJK5678F and send the message to either 567678 or 56161
If there is any mismatch in Aadhaar name given by you when compared to the actual data in Aadhaar, One Time Password (Aadhaar OTP) will be sent to the mobile number registered with Aadhaar. Make sure that the date of birth and gender in PAN and Aadhaar are exactly the same. There is no need to login or be registered on E-filing website. This facility can be used by anyone to link their Aadhaar with PAN.
